The Iowa Department of Health and Human Services has created a free website where employers may make support payments online. To submit support payments online, you must agree to the terms and conditions of use.
Nothing on the employer website should be understood as legal advice.
DEFINITIONS
Please refer to the Glossary for more definitions. You can view our Glossary at any time by clicking on the Glossary link at the bottom of each screen."The Department" means the Iowa Department of Health and Human Services.
"We," "us," and "our(s)" refers to the Iowa Department of Health and Human Services.
"You" and "your(s)" refers to each employer who registers to use the Department's online payment service.
"Support" or "support payments" shall have the same meaning as provided in Iowa Code section 252D.16.
THE AGREEMENT
When you select "I Accept the Agreement" after reading the Terms and Conditions of Use, you are entering an agreement with us. The Agreement includes the Terms and Conditions of Use plus the Glossary, the Employer Registration form, and the Privacy Statement and Policy, which are incorporated into the Agreement by their reference here. No other written or verbal communication forms any part of the Agreement. The Agreement is limited to the employers’ online payment service. The Agreement is a binding contract.EMPLOYER REQUIREMENTS
As part of the requirements to use our online payment service, you state as true:- You are an employer who is required to send support payments to the Collection Services Center in Des Moines, Iowa.
- Your email address is valid and unique and you have access to the Internet.
- You are the owner or authorized user of the financial institution/bank account from which you will authorize electronic debits to pay employee support payments to the Collection Services Center.
- Your account is in a financial institution/bank that is located in the United States.
- You are not a minor.
PAYMENT ENTRY
Although we are not providing a banking service, you understand and agree that when you submit payments on the employer website, you are authorizing us to begin an electronic transaction that removes money from your financial institution/bank account. You agree you are financially responsible for any payment submitted using your User ID and password, unless you timely cancel the payment.CONFIDENTIALITY
PASSWORD
You agree to treat your password and User ID as confidential. You agree you will assume all risks and losses associated with the disclosure of your User ID or password.You also agree to call our employer customer service call center, EPICS, at 877-274-2580 Monday through Friday, 8 a.m. to 4:30 p.m., Central Time, excluding state holidays, or email csrue@hhs.iowa.gov if you believe:
Your password has been lost or stolen,
- Someone may attempt or has attempted to use your password without your consent,
- Someone has used your password to transfer money without your permission, or
- There has been any other security breach.
PROHIBITED USE OR DISCLOSURE
The information contained on the employer website and the layout and operation of our online payment service may not be disclosed, copied, displayed, distributed, downloaded, licensed, modified, published, reposted, reproduced, reused, sold, transmitted, used to create a derivative work or otherwise used for public or commercial purposes, without our express written permission.You understand support information, including any payment information on the employer website, is confidential and you may disclose it only as provided by law. Wrongful access to and the use or disclosure of confidential support information is a criminal offense.
DISCLOSURE OF YOUR INFORMATION
You consent to our disclosure of information about your employer account or transactions when disclosure is necessary to complete or cancel a payment. You agree to provide financial information to us, upon request, to facilitate the payments you submit. You can view our Privacy Statement and Policy at any time by clicking on the Policies link at the bottom of each screen.CANCEL ACCESS & TERMINATE ONLINE PAYMENT SERVICE
You understand our cancellation or suspension of your access to our online payment service or our termination of our online payment service for all employers has no effect on your obligation as an employer to withhold and send support payments to the Collection Services Center.YOU MAY CANCEL A PAYMENT OR STOP USING OUR ONLINE PAYMENT SERVICE
You may cancel a payment if we have not begun processing it (in other words, the payment is still in "Initiated" status). If you choose to stop using our online payment service, the payment address is Collection Services Center, PO Box 9125, Des Moines, IA 50306-9125. If you have cancellation questions, please call our employer customer service call center, EPICS, at 877-274-2580 Monday through Friday, 8 a.m. to 4:30 p.m., Central Time, excluding state holidays, or email csrue@hhs.iowa.gov.WE MAY CANCEL OR SUSPEND YOUR ACCESS TO OUR ONLINE PAYMENT SERVICE
We retain the right to cancel your access to our online payment service and reject any transaction for any reason and without advance notice, penalty, or liability. The Department may suspend your access to our online payment service for one year if your financial institution/bank does not honor a deduction from your designated account.WE MAY TERMINATE OUR ONLINE PAYMENT SERVICE
We retain the right to terminate our online payment service for any reason and without advance notice, penalty, or liability.PROHIBITED ACTIVITIES & LEGAL COMPLIANCE
You agree you will not use any data monitoring, copying, or extraction tools, whether automatic or manual, and your activities on the employer website will not be false, inaccurate, or misleading. You also agree you will not introduce any computer programming routines or other harmful devices or components that may damage or interfere with our system, data, or the information therein.You agree you will comply with all applicable state, federal, and international laws, statutes, ordinances, rules, and regulations. If you are an employer whose principal place of business is not the United States, you state as true that you are not violating any law or regulation by using our online payment service.
You agree to cooperate with and assist us in any investigation concerning use of our online payment service.
GOVERNING RULES, LAW, & FORUM
NACHA RULES
The Automated Clearing House (ACH) network is the electronic funds transfer system, which is used to debit and credit customer accounts and to make bank-to-bank transfers. The ACH network is governed by the National Automated Clearing House Association (NACHA) mandatory operating rules, which are binding on the transactions and relationships they govern. You agree NACHA operating rules regulate all transactions of our online payment service, including those where you and the Department have accounts in the same bank.GOVERNING LAW AND FORUM
You agree that the Agreement shall be, in all respects, governed and construed in accordance with the laws of the State of Iowa, without giving effect to Iowa’s choice of law principles. You agree and consent that all litigation or actions commenced in connection with or arising out of this Agreement, including after cancellation of the Agreement or termination of our online payment service, shall be brought and maintained exclusively in Des Moines, Iowa.NO WARRANTIES
Our online payment service and all supporting documentation are provided to you "as is" and "as available". Except as expressly set forth in this Agreement, we make no warranties or representations concerning the hardware, third-party hardware, software, third party software, or use of this system, whether express, implied, or statutory, including without limitation, warranties of good title, information content, accuracy and system integration, warranties against infringement, and warranties that may arise or be deemed to arise from any course of performance, course of dealing, or usage of trade.We disclaim all implied warranties of fitness and state there are no warranties that extend beyond the description on the face of the Agreement. We disclaim all warranties and conditions of merchantability, whether express, implied, or statutory, and of non-infringement.
We do not warrant that use of our online payment service is without defect or error, or that the operation of the system will be uninterrupted. We make no warranties regarding the amount of time required for you to enter and for us to accept and process your payment instructions. We do not warrant this site, its servers, or email sent from us are free of viruses or other harmful components.
INDEMNIFICATION
You agree to indemnify and hold harmless the State of Iowa and the Department, its officers, employees and agents appointed and elected and volunteers from any and all costs expenses, fines, losses, claims, damages, liabilities, settlements and judgments, including reasonable value of the time spent by the Attorney General’s Office, and the costs and expenses and reasonable attorney fees of other counsel required to defend the State of Iowa or us for any reason related to your use of our online payment service, including:- Our inability to complete your e-payment transaction for any reason associated with your transaction or bank account, including submitted payment amounts for which your account has insufficient funds and our subsequent attempts to collect the amount directly from you,
- Assessments, fees, or penalties from financial institutions, according to NACHA rules, and any damages resulting from the circumstances surrounding the assessment, including the event that caused the assessment,
- Your access or use, including that by an unauthorized third party using your User ID or password, which causes damage to our computers or software, including introduction of a virus, worm, or other malicious or harmful computer code,
- Payments submitted using your User ID and password,
- Your improper disclosure of support information,
- Your filing a claim or action against us in a jurisdiction other than the one named in the Governing Law and Forum section above,
- Your violation of any law or the rights of a third party by your use of the online payment system,
- Your entry of support information on a counterfeit site, and
- Your breach of the Agreement.
NO LIABILITY
We specifically disclaim any liability, whether based in contract, tort, strict liability or otherwise, for any direct, indirect, incidental, consequential or special damages, arising out of or in any way connected with your access, use, or browsing of the employer website, or Internet links appearing on the site.You agree you are responsible for obtaining, installing, maintaining, repairing, and operating all of your own hardware, software, and Internet services, which are necessary to use our online payment service. You agree we are not liable for any loss, injury, or damages, including lost profits that result from your installation and use of your hardware, other equipment, software, or Internet service or any errors, failures, or malfunctions resulting from that installation or use.
You agree we are not liable for any damages that result from your use of or inability to use our online payment service. You agree we incur no liability if we are unable to properly complete your payment instructions for any reason, including but not limited to the following causes:
- Your payment instructions are not accurate.
- Your instructions, including cancellation or modification, are not timely executed by our financial institution or your financial institution after we promptly report your instructions.
- Our online payment service is not working properly.
- Circumstances beyond our control.
NO WAIVER
We do not waive any of our rights or remedies under the Agreement. No delay or omission on our part in exercising any rights or remedies will act as a waiver of such rights or remedies or other rights or remedies. A waiver of a right or remedy by us on any one occasion must not be understood as a bar or waiver of any of our rights or remedies on future occasions.As an executive agency of the State of Iowa, we do not waive sovereign immunity by providing the employer online payment service or entering into the Agreement. We specifically retain and reserve the defense of sovereign immunity for any action, damages, or liability arising outside of the terms of the Agreement. Further, we retain all defenses available to us or the State of Iowa under State and Federal laws, rules and regulations, including without limitation Iowa Code chapter 669, and the Constitution of the State of Iowa for any claim arising out of or related to the Agreement.
ELECTRONIC TRANSACTIONS, SIGNATURES, AND RECORDS
You consent to the use of electronic transactions and signatures and receipt of electronic versions of certain records. In addition, you agree to be bound by any consent or agreement you make or transmit through the internet or the employer website, including but not limited to any consent you give to receive records or communications from us solely through electronic transmission. You agree that, by selecting "I accept the Agreement" and subsequent use of our online payment service, your Agreement or consent will be legally binding and enforceable and the legal equivalent of your handwritten signature.ALTERATIONS AND AMENDMENTS
We retain the right to unilaterally change the Agreement. We will post changes on the employer website. To use our online payment service after changes are posted, you must agree to the changes. However, changes to our Privacy Policy will become effective thirty (30) days after we give you notice.By selecting "I Accept the Agreement", you acknowledge you have read the Terms and Conditions of Use and other documents on the employer website that are part of the Agreement. You also acknowledge you have had the opportunity to consult counsel as necessary for you to form a complete understanding of all rights and obligations of the Agreement and you freely agree to accept those rights and obligations. Accordingly, you agree the Agreement must not be construed or interpreted against us on the basis of its drafting or preparation.
In consideration of the formal promises set forth in the Agreement and for other valuable consideration, the receipt, adequacy and legal sufficiency of which you acknowledge, you and the Department are about to enter into the binding online payment service Agreement.
After you select "I Accept the Agreement", you will be able to use our online payment service. Please keep a copy of these Terms and Conditions of Use.
By selecting "I Do NOT Accept", you acknowledge you do not agree to be bound by the Terms and Conditions of Use. You understand you will not be able to use our online payment service. However, you will be able to report employee terminations and temporary absences online and use the new hire reporting service provided on the employer website.
